The EB-3 Visa Process in 4 Steps

PERM Labor Certification
Before applying, the U.S. employer must obtain a PERM Labor Certification from the Department of Labor. This ensures that no qualified U.S. workers are available for the position and that hiring a foreign worker won’t negatively impact local wages and working conditions.

I-140 Immigrant Petition
Once the labor certification is approved, your employer files Form I-140 (Immigrant Petition for Alien Worker) with USCIS. This step establishes that the employer has the financial ability to pay your wages and that you meet the job qualifications.

Visa Availability & Priority Date
After the petition is approved, you must wait until your priority date (the date the labor certification was filed) becomes current, according to the U.S. State Department’s Visa Bulletin. Only then can you proceed with the final step.

Green Card Application (I-485 or Consular Processing)
If you are already in the U.S., you file Form I-485 (Adjustment of Status). If you’re abroad, you go through consular processing at a U.S. embassy or consulate. Once approved, you receive your Green Card and can live and work permanently in the United States.
